1. Preamble
   The partner program specified in these terms of use serves to obtain orders on emerion. On the account of the affiliate a commission is credited, if an order is placed on the special order page of the partner, which is successfully closed.
 

2. Participation
   Each internet user can participate the emerion affiliate program, who would like to obtain orders on emerion. A condition for the participation is the registration at the emerion partner program. On registration the partner receives an account. The registration, participation and the set up of the partner account is free of charge. With the registration of the account the partner accepts the conditions and the current terms of use.
 

3. Commissions
   The partner receives a unique commission, which is credited to its account for an order. The commission depends on the ordered Top Level Domain, as well as on the selected product. The current commission for each product is evident in the partner account.
   A commission for an order is taken into account to the partner only if the order is placed at the special order page of the partner. For orders placed not at the special order page of the partner, no commissions can be taken into account.
   If a domain name is transferred away within 3 months after ordering, or the cancellation of services for any other reason with immediate effect takes place within 3 months after ordering, a back-posting of the commission is taken into account for the cancelled service.
 

4. Settlement and payout conditions
   The commissions listed in the partner account, which come only by orders over the partners order web page, are the basis for settlement. The payout takes place on the bank account indicated in the partner account. The payout of the commissions taken into account takes place monthly up to 15th of the subsequent monthly, if the assets at the partner account amount is at least 25.00 EURO.
   If the assets amount is less than 25.00 EURO net, emerion will only pay the commissions in the month at the time mentioned, in which all not paid out commissions of the partner amount to cumulated at least 25.00 EURO net.
   For each payment emerion provides a credit note, which corresponds to the measure gifts of the tax legislation. The assets of the partner is not paid interest on.
   If the payout is not possible, due to not correctly indicated bank account information by the account owner, emerion is not obligated to make the payment on another account. There is not a requirement on a commission, which cannot be paid, due to wrong bank account information.
 

5. Asserting of requirements
   The asserting of requirements from commissions opposite emerion, which do not correspond to the Settlement and payout conditions, is by agreement excluded. For orders placed by a partner not on the special partner order web page, no requirement on a commission exists.
 

6. Non-liability
   For claims for damages, liability claims and other costs, which appear by the mounting from links on a partners web site with force representation, sexually clear contents or discriminating statements or representations regarding, race, sex, religion, nationality, handicap, sexual inclinations or age, which refers to emerion and or refers to other sites with appropriate contents, the partner is responsible opposite emerion.
 

7. Availability
   emerion operates the systems as usual in the internet industry to ensure that the systems remains available 24 hours the day. Excluded are interruptions, which are usual for necessary maintanence or through third parties, not associated with emerion. If the systems should fail, emerion will strive immediately in the context of its possibilities of re-establishing the availability. The partner recognizes that in exceptional cases thereby transactions cannot be seized and/or logged by the system. A requirement approximately emerion does not exist from this.
 

8. Running time/cancellation
   The contract between emerion and the partner starts, if the partner registered online at the emerion affiliate program and on the part of emerion the registration is confirmed by email containing the access information for the partner account.
   The contract can be quit from both sides at any time verbally or in writing. With the cancellation the parnter account is closed and up to the effectiveness of the cancellation all resulting commissions are paid out.
   Starting from effectiveness of the cancellation no commissions are paid, even if further orders are placed at the special order page of the affiliate.

9. Changes of the Terms Of Use
   Changes of the conditions and Terms Of Use are possible at any time by announcing them under adherence of a period of 2 (two) weeks. The changes are announced by email and are accessible in the partner account. If no express, written contradiction takes place within the announcement period, the new conditions and Terms Of Use are considered as accepted.
 

10. Data security and privacy
    Account information, orders and commission transactions are stored and processed electronically. Additionally emerion stores the email communication between the affiliate and emerion.
    All contact information, as well all communication is assigned to your account profile and is treated strictly confidential by emerion. Any necessary contact information is given to reliable contracting parties only if it is necessary to establish a service.
    emerion never passes customer information and/or partner information for marketing purposes to third parties, also not, that product informations can be sent to you, from which is accepted that these could be of interest for you. emerion treats all contact information confidential and does not pass email addresses to third parties.
